1. Acceptance of Terms

By accessing and using the Proudly Human mobile application (the "App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms and Conditions, please do not use the App.

The App is operated by 23 First Corporation trading as Proudly Human Corporation. These Terms and Conditions apply to all users of the App.

2. Description of Service

The ProudlyHuman™ App provides users with the ability to:

• Search for books by title, author, or ISBN
• Scan book barcodes using their device camera
• View whether books are ProudlyHuman™ certified
• Access information about the ProudlyHuman™ certification program

The App does not require user registration, login credentials, or payment processing.

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms and Conditions. You agree not to:

• Use the App in any way that violates any applicable local, state, national, or international law
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the App
• Take any action that imposes an unreasonable or disproportionately large load on our infrastructure
• Use any robot, spider, or other automatic device to access the App for any purpose without our express written permission
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App

4. Camera Permissions

The App requests access to your device's camera solely for the purpose of scanning book barcodes. Camera data is processed locally on your device and is not stored, transmitted, or retained by 23 First Corporation. You may revoke camera permissions at any time through your device settings.

5. ProudlyHuman™ Certification Information

The certification status displayed in the App is provided for informational purposes only. While we strive to maintain accurate and up-to-date information, we do not guarantee the completeness, accuracy, or timeliness of the certification data. Certification status may change without notice.

6. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by 23 First Corporation, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

23 First Corporation does not warrant that the App will function uninterrupted, secure, or available at any particular time or location; that any defects or errors will be corrected; or that the App is free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will 23 First Corporation, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the App, any websites linked to it, any content on the App or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages.

9. Changes to Terms

We reserve the right to modify or replace these Terms and Conditions at any time at our sole discretion. The date of the most recent update will be indicated at the top of this page. Your continued use of the App following the posting of any changes constitutes acceptance of those changes.
